1. SMS service alerts program

Program name: Gingersnap Software Service Alerts

Program description: When you opt in, Gingersnap Software sends automated text messages about the status of the Gingersnap Software applications you use. These include system outages, service degradation, scheduled maintenance, and incident resolution. We do not send marketing messages through this program.

How to opt in: Enter your mobile number in your application's account settings and check the SMS consent box. You will receive a confirmation message. Consent is not a condition of purchase.

Message frequency: Varies based on system events.

Cost: Message and data rates may apply. Check with your mobile carrier for details about your plan.

How to opt out: Reply STOP to any message at any time. You will receive one final message confirming you have been unsubscribed, and no further messages will be sent. To rejoin, opt in again through your account settings.

Carrier liability: Mobile carriers are not liable for delayed or undelivered messages. Delivery of messages is not guaranteed and may be affected by factors outside our control, such as carrier coverage and network availability.

Eligibility: You must be at least 18 years old and the account holder, or have the account holder's permission, to enroll the mobile number you provide.

Privacy: Your information is handled as described in our Privacy Policy. We do not share mobile information with third parties or affiliates for marketing or promotional purposes.

2. Use of the Services

You agree to use the Services only for lawful purposes and in accordance with these Terms. You are responsible for keeping your account credentials secure and for all activity under your account.

The Services and all related software, content, and trademarks are owned by Gingersnap Software LLC or its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Services according to these Terms and any agreement you have with us.

The Services, including SMS alerts, are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied. SMS alerts are a convenience and should not be your only means of monitoring critical systems.

5. Limitation of liability

To the fullest extent permitted by law, Gingersnap Software LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from delayed, undelivered, or inaccurate messages.

6. Changes to these Terms

We may update these Terms from time to time. We will post the updated version with a new effective date. Continued use of the Services after changes take effect means you accept the updated Terms.

7. Governing law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law rules.
